10. Vote to confirm the appointment of Leonard R. Beane of Southbridge as Police Officer for the Town of Southbridge pending successful completion of a physical by the Town Physician.

11. Vote to confirm the appointment of Luis Torres of Sturbridge as Police Officer for the Town of Southbridge pending successful completion of a physical by the Town Physician.

12. Vote to confirm the appointment of Ryan K. Chase as Police Officer for the Town of Southbridge pending successful completion of a physical by the Town Physician.

13. Vote to approve the following four (4) individuals to the Southbridge Auxiliary Police for a 3-year term to expire June 30, 2015.
- Adrianna DiPietro, Southbridge MA
- Kimberly Jeznach, Sturbridge MA
- Santino Marcucci, Southbridge MA
- Thomas Palmerino, Southbridge MA

14. Vote to confirm the appointment of Evelyn Rivera as Municipal Hearing Officer for a one-year term effective July 1, 2012 through June 30, 2013.

15. Vote to confirm the appointment of Yvonne Tortis as Municipal Hearing Officer for a one-year term effective July 1, 2012 through June 30, 2013.

16. Vote to reappoint Karen Harnois as Town Accountant / Finance Director for a 5-year term effective August 25, 2012 through August 24, 2017 and to ratify updated employment agreement.

17. Vote to confirm the appointment of Atty. Michael E. Scott of Nutter McClennan & Fish, LLP as special Attorney representing the Town in regards to the Landfill Extension Agreement.

18. Vote to confirm the appointment of Atty. John Gorgio of Kopelman and Paige for the purpose of assisting in the location of the solar leases that the Town may engage or enter into at various locations to be determined.

19. Vote to approve the signing of the warrant for the Annual Town Election scheduled for Tuesday, June 26, 2012.

20. Vote to accept the provisions of Chapter 176 of the Acts of 2011, Section 29 and 30 thereby increasing the minimum monthly allowance contained in G.L. c.32 §12(2)(d) from $250 to $500 per month.

21. Ordered: that $150,000 is appropriated for the purchase of self-contained breathing apparatus; that to meet this appropriation, the Treasurer with the approval of the Town Manager is authorized to borrow $150,000 under Chapter 44 of the General Laws and to issue bonds or notes therefore.

22. Ordered: that $90,000 is appropriated for Library Improvements, including improvements and repairs to the retaining wall, parking lot and other interior improvements; that to meet this appropriation, the Treasurer with the approval of the Town Manager is authorized to borrow $90,000 under Chapter 44 of the General Laws and to issue bonds or notes therefore.

23. Ordered: that $125,000 is appropriated for the purchase of a backhoe; that to meet this appropriation, the Treasurer with the approval of the Town Manager is authorized to borrow $60,000 under Chapter 44 of the General Laws and to issue bonds or notes therefore and $65,000 to be funded from Sewer retained earnings.

24. Vote to approve Change Order No.6 in the amount of $37,577 revised total as requested by Consigli Construction and recommended by Joslin Lesser & Associates for the Middle / High School Project.

25. Vote to ratify the agreement between the Town of Southbridge and Whalley Computer Associates for computing equipment and Services Technology Group Bid portion of Bid #2012-10 in an amount not to exceed $146,334.93 for the new school project, pending final bid review, reference checks and School Building Committee approval.

26. Vote to ratify the agreement between the Town of Southbridge and HIQ Computer, Inc. for the Server Technology Group Bid portion of Bid #2012-10 in an amount not to exceed $76,859.44 for the new school project, pending final bid review, reference checks and School Building Committee approval.

27. Vote to ratify the agreement between the Town of Southbridge and HIQ Computer, Inc. for the Tablet Technology Group bid portion of Bid #2012-10 in an amount not to exceed $189,213.95 for the new school project, pending final bid review, reference checks and School Building Committee approval.

28. Vote to ratify the agreement between the Town of Southbridge and Whalley Computer Associates for the Aerohive Wireless Network Contract, to be purchased off of a State purchasing contract in an amount not to exceed $45,007.00 for the new school project, pending final bid review, reference checks and School Building Committee approval.

29. Vote to accept the layout of Commercial Drive including all related and supporting easements, shown as “COMMERCIAL DRIVE (VARIABLE WIDTH) 531,185 sq. ft. 12.20 acres” on a plan entitled “PLAN OF COMMERCIAL DRIVE IN SOUTHBRIDGE, MASSACHUSETTS FOR THE INHABITANTTS OF THE TOWN OF SOUTHBRIDGE dated “May 7th, 2012” prepared by “WESTON & SAMPSON ENGINEERS, INC. 100 FOXBOROUGH BOULDEVARD, FOXBOROUGH, MA 02035” (the “Layout Plan”)  and further, that the Town Manager is authorized to acquire or commit any necessary land or interests in land by gift or restrictive covenant as follows:
1. Three (3) DRAINAGE EASEMENTS in DEED BOOK 34304, PAGE 278 on Layout Plan Sheet 1 and Sheet 2.
2. PROPSED (sic) DRAINAGE EASEMENT “A” 734 SF ± on Layout Plan
3. PROPSED (sic) DRAINAGE EASEMENT “B” 808 SF ± on Layout Plan
4. PROPOSED DRAINAGE EASEMENT “C” 32995 SF ± on Layout Plan
5. Deed in fee simple for triangular shaped parcel shown as “PROPOSED EASEMENT “D” 9700 ± on Layout Plan Sheet 5.
and further that the Town Manager is authorized and directed to record all necessary documents with the Worcester District Registry of Deeds and to do all necessary acts to complete this road acceptance process.

  1. I have questions regarding two of the agenda items that maybe someone can enlighten me on. The first one is #18. Why is John Gorgio involved with this? I thought we were only using Kopleman & Paige to complete any existing items.

    The other question is on #21. Is the breathing appratus for the fire department?

  2. Regarding #21, it is the breathing apparatus that our firefighters use. At the General Government subcommittee meeting this week, it was stated that the existing equipment is coming up on its natural expiration and needs to be replaced.

    As for #18, the administration is looking to use Gorgio/Kopelman & Paige to negotiate solar leases only. The administration noted that upon asking around on solar leases, Gorgio is considered the top guy for that particular task (the most experience with it, best track record, etc.). More or less, they're planning to use him as a mercenary for this one piece.

He's a wolf in sheep's clothing, just like Walter Bird. He pretends to have no opinions and then he endorses this boob, Giorgio? You've lost my respect and my vote. DON'T VOTE FOR MORIARITY, a puppet of Vecchia. Buyer beware!

    4. As a clarification, my previous post was an informational response to another poster's question. My post was not based on my opinions or beliefs, but rather the information that was presented at the General Government subcommittee meeting.

      If one reads what I wrote straightforward, it simply states that the administration is planning to use Kopelman & Paige for the solar lease negotiation. My intent was not to express some sort of general support or admonishment of Kopelman & Paige, John Gorgio, Chris Clark, etc., but rather the intent was to briefly answer a reader's question with what the General Government subcommittee members said the other night.

      At no point in the post do I state that I believe Kopelman & Paige is the best firm out there, simply that the administration said this or stated that. My comments were purely from the perspective of reporting what those officials present at the meeting stated.

    7. Damn, I've been outed. I was hoping my deep-seeded love for Clemence, Nikolla and Apple Vecchia (how in the world does he come into play with this?) would be able to lay under the surface for nobody to see.

      In all seriousness, however, it was Nikolla who made the "pit bull" reference, not I. I referred to Gorgio as a mercenary (one who is working or acting merely for money or other reward).

      My comments, which are obviously up for anyone to view in the link provided here and on Marketti's site, was that Kopelman & Paige is an expensive law firm but that they are effective in what they do (which I stand by ... we may not agree with what they do or how they do it, and their local reputation is obviously piss poor, but it is a high-powered and effective law firm).

      I would not support Kopelman & Paige to be hired as town counsel, the position they previously held.

      I'd spend more time on this, but I need to drop my pom poms and get the house ready for my weekend party with Apple, Clemence and Nikolla. Good times.

      I finally watched the subcommittee meeting.. You are saying that you are going with Clark’s opinon about Kopelman and Page.
      Did you do any research of you own about Giogo’s expertise on solar?
      Your just swallowing what Clark is telling you just like Nicola.
      I was a strong fan when you said you were running. Well keep running because I’m giving up on you.

    9. The problem with Mr. Clark is that he lies so hard and often that you really do need to take the time to independently verify everything he says. It's a huge pain in the ass.

    10. This is a problem with the system of government we have. Part time counselors need the time to verify the information they get from the administration. It has nothing to do with liking or not liking the town manager. It's not good enough to simply accept what the administration says; you have to bring something more to the table so issues can be hashed out in detail. It's easy for the administration to lead you around by the nose if you don't do your homework, if you're simply sitting on the council to support the manager or you're afraid to publically disagrre with someone. You're elected to serve the people not the administration.

    A street sweeper now a backhoe boy dpw hasnt asked for anything in awhile, so lets give the the skies the limit treatment Hey Clark they need 2 new F-350's and a new tenwheeler too charge that to the sewer account too that way you can just raise that up next year without any council opposition your such a good manager i would recommend you to sturbridge as manager they need new equipment too im sure you can shake there money tree So you and Dan can help pay for it!

    1. i am very upset to see this backhoe issue!!!! i pleeded with them in december to hold off on the street sweeper because we have much more pressing things we could be doing with the money, OUR MONEY. i was told that if they passed the sweeper that night then our area would become a priority......well we haven't had one thing done in our area by the town since. we had a private citizen organize a tree planting day which was amazing....but that's all that has happened. now $125 for a backhoe? and $90k for library improvements?? what the hell is going on here? we pay our taxes. and i was told by mr. clark last week that he is "still waiting for the money from the state that will be for tornado cleanup....but it will only be allowed for pleasant street and the airport." so that leaves out worcester street, charlton street and brookside road. is that fair??? i do not want to be a part of politics, i just want to see done what is right

Isnt that nice.Dan dont hold your breath for any help from nikolla clemence spinelli Or clark its NOT coming that i know for a fact! Its election time and clemence and spinelli expect your vote for what they have done for you so far, you said you dont want to be part of politics but guess what you are being used by those political hacks as a pawn Tell your neighbors friends and family that you have had it with their false promises and vote those hacks out of office! Dan i feel for you and your neighbors because i was one of many that was helping last year right after the storm i was at your house and many others to lend a hand.
