Is Romney Criminally Liable In Federal Disclosure?

On September 27 Justin Ruben, Executive Director, Political Action sent a legal memo to  Jack Smith, Esq., Chief Public Integrity Section U.S. Department of Justice.

The seven page memo concluded:

“The facts known about Gov. Romney’s role in Bain Capital entities after 1999 strongly suggest that Gov. Romney made a false statement in violation of the False Statements Act in categorically asserting, in 2011, on his Financial Disclosure Form, that since February 1999, he had not been involved in the operations of any Bain Capital entity in any way. At a minimum, the facts call out for a full investigation by the U.S. Department of Justice.”

The memo was written by Joseph E. Sandler. Mr. Sandler is a member of the firm Sandler, Reiff, Young & Lamb, P.C., in Washington, D.C., concentrating in campaign finance, election law, non-profit organizations, government ethics and regulation of lobbying, and corporate and tax issues affecting political and advocacy activities.

    18 USC § 1001 - Statements or entries generally

    (a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully—

    (1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact;

    (2) makes any materially false, fictitious, or fraudulent statement or representation; or

    (3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;

    shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both. If the matter relates to an offense under chapter 109A, 109B, 110, or 117, or section 1591), then the term of imprisonment imposed under this section shall be not more than 8 years.

    Now combine that with the persona of a Jack Smith; a 40+ yrs.-old prosecutor who’s reported to excel in courtroom work, has a stellar record, and was brought in to restore the elite units credibility.
